01What this agreement covers
These Terms & Conditions form the contract between you (the parent or adult student enrolling in Educatta classes) and Educatta Pty Ltd (ABN 70 682 384 229; referred to here as "Educatta"). They apply to all class enrolments, free trials, online sessions, and use of any Educatta-supplied workbooks or materials.
By enrolling (even for a free trial) you confirm that you've read these terms, our Code of Conduct, and our Child Safe Policy, and that you accept them on behalf of yourself or the student.
02Enrolment, trials & placement
Free trial classes are offered with no card required. Enrolment in a paid term is confirmed only when we've received either full payment or a signed payment plan agreement.
Trial classes are free as a trial only. If you decide to enrol in the subject after the trial, the trialled classes count as your first classes of the enrolled term and are paid for as part of that term's fee. They remain free only if you choose not to continue.
We reserve the right to decline enrolment or move a student between classes if our placement assessment indicates a different class is a better academic fit. We'll always discuss this with the parent before making any change.
03Fees, payment & payment plans
Term fees are invoiced at the start of each 10-week term. Payment is due within 7 days of the invoice date. We accept direct debit, bank transfer, and credit/debit card.
We also offer a four-instalment plan, with no surcharge, payable across the term. Ask at booking. Late payments more than 14 days overdue may attract a $25 administrative fee and may result in suspension of attendance until the balance is cleared.
The 20% multi-subject discount stacks automatically: every subject after the first is 20% off, applied at invoice. See pricing for examples.
04Refunds
Educatta does not offer general refunds for changes of mind, missed classes, or mid-term withdrawal. Once you enrol in a term, the term fee is non-refundable. If a student stops attending part-way through a term, the balance of the term is not refunded.
The only path to a refund is our 100% money-back guarantee, which applies after two consecutive terms with no measurable improvement (subject to the conditions on the Guarantee page). See the Guarantee page for the full eligibility criteria and process.
05Workbooks, mocks & intellectual property
All Educatta workbooks, mock exams, marking schemes, summary sheets, and recordings are the intellectual property of Educatta. They are licensed to enrolled students for personal study use only.
You may not reproduce, redistribute, sell, post publicly, upload to study-sharing platforms, or share with non-enrolled friends without written permission. Breach of this clause may result in immediate termination of enrolment without refund and recovery of any commercial loss caused.
06Photo & video consent
By enrolling a student at Educatta, the parent or adult student agrees that Educatta may capture photographs, audio recordings and video of classes, centre activities and online sessions, and may use that material for the following three purposes:
- Tutor training and quality assurance. Recordings are used internally by our Head of Education and Learning Advisors to coach tutors, calibrate teaching standards across centres, and review classroom delivery. These recordings are not shared outside Educatta.
- Safeguarding and compliance. CCTV at our centres and recordings of online classes are kept for a limited period as part of our Child Safe Policy, to investigate incidents or complaints, and to demonstrate compliance with the Working with Children (Criminal Record Checking) Act 2004 (WA), the Children and Community Services Act 2004 (WA), and our duty of care obligations.
- Marketing and advertising. Photographs, short video clips and class footage may be used on our website, social media accounts, printed materials, paid advertising, and at school visits or events to promote Educatta. This may include images that identify a student.
For each of these purposes we apply the following safeguards:
- Recordings used for training and compliance stay within Educatta and are stored securely.
- For marketing and advertising use, we will not publish a student's full name alongside their image without separate written consent. We will not use images of a student in any context that could reasonably be considered embarrassing, demeaning, or unsafe.
- We will never sell, license, or transfer student images to third parties for their own marketing purposes.
Opting out. You can opt out of marketing and advertising use at any time, in whole or in part, by emailing learn@educatta.com from the parent's registered email address. We will action opt-out requests within 14 days, remove the student from new marketing material, and make reasonable efforts to remove existing material from our owned channels (website, social media). Opting out of marketing does not affect the safeguarding/compliance use described above, which is necessary for child safety and our legal obligations.
Opt-out preferences can also be set or changed at any time on the enrolment form, the welcome interview, or by speaking to the Learning Advisor at your centre.
07Liability & insurance
Educatta accepts liability for damages caused by our own negligence to the extent allowed by law. We carry public liability insurance covering our centres, online classes, and our staff in the course of their employment. We carry workers' compensation insurance in accordance with the Workers Compensation and Injury Management Act 2023 (WA) for all our staff, including casual tutors.
We are not liable for personal property left at our centres (laptops, calculators, AirPods, etc.). Students are responsible for their own belongings.
Tutoring outcomes (including ATAR, school grades, and test marks) depend on student effort, attendance, and many other factors outside our control. Educatta does not guarantee a specific score or grade except as expressly described on the Guarantee page.
08Privacy
We collect only the personal information needed to enrol a student and run our classes (contact details, school, year level, subjects, and progress notes). We do not sell or share this information with third parties for marketing.
We use Airtable for our internal student database and GoHighLevel for parent communications. Both are reputable providers with their own published privacy practices. You may request a copy of any information we hold about you, or its deletion, by emailing learn@educatta.com.
09Our tutors
Tutors are engaged by Educatta as casual employees, not independent contractors. Every tutor signs a separate Tutor Employment Terms & Conditions agreement covering rate of pay (at no time below the relevant Modern Award), superannuation, the Working with Children Check requirement, the Code of Conduct, the Child Safe Policy, and the confidentiality of student information.
Every tutor holds a current and unexpired Working with Children Check before any contact with students, completes our in-person child-safe induction, and is covered by our public liability and workers' compensation insurance while delivering classes.

10Changes to these terms
We may update these terms from time to time. Material changes will be notified to enrolled families by email at least 14 days before they take effect. The version number and effective date at the top of this page always reflects the current version.
11Governing law
This agreement is governed by the laws of Western Australia. Any dispute that can't be resolved through good-faith communication will be referred to mediation in Perth before any court action is taken.
